PRODUCT WARRANTY

CONGRATLUTIONS on the purchase your new sun control products from The Awning Company. Proudly manufactured right here in the USA, your shade products are designed for years of trouble free service. We warrant our products, frames, fabric covers, motors and electronics to be free from manufactures defects under normal and proper use for the period stated below. The product limited warranties apply from the date of original installation and applies to the original purchaser only, unless otherwise stated in writing. Upon expiration of the limited warranty you will be charged for any and all repairs. You will also be charged for any repairs not covered under this limited warranty. Any failure to pay the balance due upon installation will nullify the warranty until outstanding balance is brought current. Any item replaced under warranty does not extend the warranty period. We do not Pro-Rate our warranties unless otherwise stated below or by the manufacturer. PRODUCT CATEGORY AND LENGTH OF COVERAGE:

The Awning Company will cover the following.

❖ Any product deemed defective under manufacturers or The Awning Company’s written warranties.

❖ *Sunbrella® Awning and Marine Canvas. Excessive fading, rotting, or mildew as described under the specific manufacturers written warranties. For installations on or after November 1, 2008, the warranty coverage period is 10 years from the original purchase date. Glen Raven will provide replacement fabric at no cost during years one through eight; at the then-current selling price less a 30% discount during the ninth year; and less a 15% discount during the tenth year.

❖ All other fabrics are covered under the specific manufacturer’s warranties.

❖ The Awning Company agrees pay for any factory labor and materials needed to repair or replace any product covered during the warranty period. What is Limited under this warranty.

❖ Lifetime Warranty on Milan Retractable arms is for as long as you or a direct family member own the property.

❖ Sunbrella fabric carries the express written warranties of the manufacturer, Glen Raven.

❖ Valance and binding is limited to a period of 1 year due to the inherent interaction with the environment.

❖ Vari pitch Shoulders and Vari-Valance components carry a warranty of 2 years.

❖ Installation and electrical hook up, if done by The Awning Company, carries a warranty of 5 years.

❖ Powder coating on all frames is warrantied against excessive peeling for a period of 2 years.

What is not covered under this warranty.

❖ Anything out of The Awning Company’s control, such as, without limitation, acts of God, wind damage, rain damage, snow damage, neglect, and failure to maintain products to a reasonable degree etc…

❖ Damage resulting in a repair or attempted repair by someone other than an authorized service representative of The Awning Company.

❖ The formation and presence of mold and/or mildew is not covered under the terms of this warranty. Mold and mildew will not grow on a man-made fiber (acrylic) unless there is organic matter (dirt) for the mold to grow on. Reasonable care should be taken to clean the fabric of any surface dirt or other organic matter to prevent the formation of mildew.

❖ Crazing (scratch looking marks in the fabric). It is an inherent characteristic of some Sunbrella fabrics.

❖ Waffling or puckering of the fabric around or near a fabric seam/hem is unavoidable during the lifetime of your fabric. This does not affect the performance of the fabric and thus is not considered a product flaw or defect.

❖ Minor color changes in the fabric during the warranty period.

❖ The cost of loss of time or loss of use due to a warranty or service repair.

❖ Damage to the valance due to interaction or rubbing on other objects or materials.

❖ Incidental and consequential damages

❖ If your product requires field labor, the field labor and expense will be provided free of charge for a period of five years from date install. If the product is returned to the factory for repair within the warranty period transportation must be prepaid. State Law Rights: Some states do not allow limitations on how long an implied warranty lasts and/or do not allow the exclusion or limitation of consequential or incidental damages, so the above exclusions or limitations may not apply to you. This warranty applies without any registration and is only valid to the original purchaser and/or home owner.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE
